Challenging the Gauteng Freeway Improvement Project e-tolls

The Gauteng Freeway Improvement System (GFIP) gantries were switched on from 3 December 2013, starting a war of attrition between the South African National Roads Agency Ltd (Sanral) and motorists who refused to pay e-tolls.

OUTA was established in 2012 to oppose the e-toll system, starting with legal action to review the decision. Although OUTA's mandate has since expanded to oppose government corruption, OUTA continued to be involved in a long-running legal battle over the constitutionality of e-tolls.

On 26 October 2022, Minister of Finance Enoch Godongwana announced in his Medium-Term Budget Policy Statement (MTBPS 2022) that alternative funding was being found for the GFIP debt, effectively ending e-tolls. The costs would be split between the national government and the Gauteng provincial government.

On 28 March 2024, the Department of Transport and Sanral gazetted the notice which formally ended the tolling of the GFIP freeways from midnight on 11 April 2024, switching off the gantries from 12 April. This notice is here.

In October 2015, OUTA set up the E-toll Defence Umbrella, a crowd-funded defence of motorists who had been issued with summonses by Sanral for unpaid e-toll debt. By the time Sanral decided in March 2019 to stop pursuing e-toll debt and stopped issuing summonses, OUTA was defending 2 028 cases on behalf of motorists which totalled R265.060 million in debt. As of April 2024, these court cases have yet to be resolved, and OUTA is working on ways of getting legal finality on this. 

OUTA is also considering the outstanding issues arising from the e-tolls, such as obtaining clarity on the historic e-toll debt, and whether Sanral intends pursuing this. Sanral to date has been unsuccessful in collecting on this debt so OUTA believes the chances of it continuing to pursue this debt are low.
