Dudu Myeni delinquency: an important legal precedent has been set

 

The Supreme Court of Appeal (SCA) on 12 April 2021 dismissed Dudu Myeni’s application for leave to appeal against the 2020 judgment which ruled her a delinquent director for life. SCA did so on the on the grounds that there is no reasonable prospect of success in an appeal and there is no other compelling reason why an appeal should be heard. 

What is exciting about this verdict, is that it opens the door for all future directors of state-owned enterprises, private businesses and non-profit organisations to be declared delinquent should they fail in their fiduciary duties. This means more accountability, something all South Africans should welcome. 

Even though it took OUTA and the SAA Pilots’ Association (SAAPA) five years and a lot of money to get this verdict, we are satisfied that our efforts will help ensure better spending of our taxes in future, thus making South Africa a better place for all.
