In 2017 OUTA laid criminal charges against Malusi Gigaba for his role in the early naturalization of the Gupta family and their associates. We were reminded of this recently when the Public Protector, Busisiwe Mkhwebane, cleared Gigaba of abusing his power.  OUTA believes Gigaba should face the full might of the law for his meddling in favour of the Guptas, as the buck stopped with him as then  Minister of Home Affairs. We also repeat our call for the removal of Mkhwebane as Public Protector.  We laid charges of perjury against her in September 2019, and her latest report on Gigaba once again underlines her bias towards people implicated in State Capture. Mark Pamensky, a former director of the state-owned Eskom Holdings, appeared at the Zondo Commission this month. We laid charges of corruption and breaching of the Companies Act and the Public Finance Management Act against Pamensky for passing on information he gained at Eskom to the Guptas. This helped them with their R2.15 billion purchase of Optimum Coal Holdings, which has coal contracts with Eskom and which received substantial help from Eskom. (Pamensky was a director of at least one Gupta owned company while still at Eskom Holdings.) We stand by our charges and believe Pamensky should be held accountable for his actions.
